ADDITIONAL TERMS FOR GENERATIVE AI PREVIEW PRODUCTS

The following terms apply to Generative AI Preview Products:

Definitions. “Generative AI Preview Products” means Generative AI Services that are Pre-GA Offerings. The Service Specific Terms applicable to Generative AI Services, as amended by the Pre-GA Offerings Terms, also apply to Generative AI Preview Products.

Additional Use Restrictions. Unless permitted by Google in writing (including in the Documentation or an Order Form), Customer will ensure that Customer and its End Users will not:

  • use a Generative AI Preview Product for commercial or production purposes; or
  • disclose Generated Output to a third party.


Grounding with Google Maps. "Grounding with Google Maps” is a Pre-GA offering and generative AI feature of Vertex AI that provides grounded responses using Google Maps Content. Capitalized terms used but not defined in these terms have the meaning given to them in the Agreement or the Maps Agreement, as applicable.

Requirements for Use

  • To use this Pre-GA Offering version of Grounding with Google Maps, Customer must have previously executed a contract governing its use of Google Maps Platform (the “Maps Agreement”).
  • Customer will comply with the terms of the Agreement, as well as the Maps Agreement, as applicable.
  • Customer must (i) be located in the United States, unless otherwise permitted in writing by Google, and (ii) only use Google Maps Content relating to establishments, geographic locations, or prominent points of interest in the United States.

Definitions

  • “Context Token” is a specific attribute, which may be used to request Grounding with Google Maps to render the specific Contextual Widget associated with that Context Token.
  • “Contextual Widget” is a Google Maps Pre-GA Offering that is a visual container to support or supplement other Google Maps Content.
  • For Grounding with Google Maps only: the definition of “Generated Output” is amended to mean the data or content generated by Google in response to Maps Grounding Prompts, excluding Google Maps Content and the Contextual Widget.
  • “Google Maps Content” has the meaning defined in the Maps Agreement. For Grounding with Google Maps, the Context Token, all content in the Contextual Widget, and all content displayed with the Generated Output that is identified by the Maps Grounding Support Metadata are Google Maps Content.
  • “Maps Grounding Prompts” mean the data and content that Customer or its End Users prompts or submits to Vertex AI, which Customer then instructs to be sent to the Google Maps Services.
  • “Maps Grounding Support Metadata” means metadata Google provides to Customer to help Customer identify other Google Maps Content in the response from Grounding with Google Maps.
  • “Prohibited Territory” has the meaning defined in the Maps Agreement.

Terms

1. Google Maps Content and Generated Output. The response from Grounding with Google Maps may display Generated Output, Google Maps Content, and the Contextual Widget. Any use of Google Maps Content, the Contextual Widget, and other Google Maps Platform Services via Grounding with Google Maps is governed by the Maps Agreement, in addition to these terms. For clarity, even if the Google Maps Content and the Contextual Widget are displayed with the Generated Output, neither are Customer Data.


2. Prompts. Maps Grounding Prompts are not Customer Data. Google will use and retain Maps Grounding Prompts to provide and improve Google products and services, subject to the Maps Agreement (including the Google Maps Controller-Controller Data Protection Terms at https://cloud.google.com/maps-platform/terms/maps-controller-terms) and the Google Privacy Policy at https://www.google.com/policies/privacy.


3. Display Requirement. In connection with the use of Grounding with Google Maps, Customer will only display the Generated Output and text of the Google Maps Content with the associated Contextual Widget, and only to the End User who submitted the Maps Grounding Prompt.


4. Use Restrictions. In connection with the use of Grounding with Google Maps and subject to the Maps Agreement, Customer will not and will not allow its End Users or any third party to:

  1. frame, syndicate, analyze, train on, or otherwise learn from Google Maps Content;
  2. modify or intersperse any other content, including any Customer provided instructions, with the Google Maps Content;
  3. place any interstitial content between any text from Google Maps Content or Contextual Widget; or
  4. distribute or market any Customer Applications in a Prohibited Territory.

5. Caching and Storing. Notwithstanding the Maps Agreement and Section 4 above, Customer may, when using Grounding with Google Maps:

  1. store or cache the text of the Google Maps Content returned alongside the Generated Output (excluding the Contextual Widget) that was displayed by Customer to the End User for up to thirty days, only to evaluate and optimize the display of that Google Maps Content for the Customer Application or to maintain a context window in the Customer Application.
  2. store the Context Token from the Google Maps Content in order to display the Contextual Widget standalone.

In addition to these terms, the Pre-GA Offerings Terms at https://cloud.google.com/terms/service-terms apply to the Customer’s use of the Generative AI Preview Products, as well as: (i) the terms of the agreement under which Google has agreed to provide access to the Google Cloud Platform to Customer, (ii) in the case of channel customers, the Google Cloud Platform Terms of Service located at https://cloud.google.com/terms, or (iii) in the case of public sector partners, the terms of the agreement under which Google has authorized that public sector partner to distribute or resell access to the Google Cloud Platform.
